BAKGRUNN (fra kommisjonsforordningen)
(1) For the active substances bispyribac, metosulam, oryzalin, oxasulfuron and triazoxide maximum residue levels (‘MRLs’) were set in Annex II to Regulation (EC) No 396/2005.
(2) The approval of the active substance bispyribac expired on 31 July 2022 as the applicant withdrew the application for its renewal. The approval of the active substances metosulam, oryzalin and triazoxide expired on 30 April 2021, 31 May 2021 and 30 September 2021 respectively, as no application for their renewal had been submitted.
(3) The approval of the active substance oxasulfuron expired on 8 August 2018 as the Commission did not renew the approval of the active substance by Commission Implementing Regulation (EU) 2018/1019.
(4) All existing authorisations for plant protection products containing those active substances have been revoked. No MRLs based on Codex maximum residue limits (‘CXLs’) or import tolerances exist for those active substances. It is therefore appropriate to set the MRLs for these active substances at the limit of determination (‘LOD’).
(5) For bispyribac, metosulam, oryzalin, oxasulfuron and triazoxide, all MRLs are already at the LOD in Annex II to Regulation (EC) No 396/2005. It is therefore appropriate to delete the MRLs set out for those active substances in Annex II to Regulation (EC) No 396/2005 in accordance with Article 17 of Regulation (EC) No 396/2005 in conjunction with Article 14(1), point (a), thereof. MRLs for all products of those active substances should be set at the product specific LOD in Annex V to that Regulation.
(6) Additionally, for metosulam and oryzalin, as the MRLs on all products are set at the product specific LODs, there is no longer a need for confirmatory data. Therefore, all footnotes containing requests for confirmatory data should be deleted.
(7) The Commission consulted the European Union reference laboratories for residues of pesticides as regards the need to adapt certain LODs. For all the active substances covered by this Regulation those laboratories proposed product specific LODs that are analytically achievable.
(8) Regulation (EC) No 396/2005 should therefore be amended accordingly.
(9) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed
